 1) Eligibility:

• Contest is open only to legal residents of the fifty (50) United States except States specifically exempted, and the District of Columbia who are eighteen (18) years of age or older.
• Employees of the Contest Host and SelfiePoll.com, their respective parent companies, affiliated companies, subsidiaries, sponsors, advertising agencies and third party fulfillment agencies and their respective agents, employees, officers, directors, successors and assigns as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to enter.
• The Contest is subject to international, federal, state, and local laws and regulations and is void where prohibited..

2) Contest Participation:

• To participate in this Contest you must:
  • Have a valid SelfiePoll.com account (an “Account”). If you do not have an Account, visit https://www.selfiepoll.com and register in accordance with the enrollment instructions for a free or Premium SelfiePoll account.
  • Agree to the Contest Rules contained in this document.

  • If you have purchased SelfiePoll.com premium services, Review and Agree to the SelfiePoll.com Cancellation and Refund Policy
  • Enter the Contest using the SelfiePoll.com online Contest Entry form.

3) Entry Compliance:

• Your Contest Photo or Contest Video must comply with the following specifications (the “Photo Entry Specifications” or “Video Entry Specifications”):
  • Be your original creation, and be a photograph or video taken solely by you. Reproducing, modifying, enhancing or altering a third party's pre-existing work does not qualify as your original creation;
  • not violate the rights of any third party, including, but not limited to copyright. For example, your Contest Photo or Contest Video must not defame, infringe or violate publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person's, entity's or organization's personal or proprietary rights, including but not limited to, intellectual property rights. For greater certainty, your Contest Photo or Contest Video must not contain trademarks, logos, or trade dress owned by anyone or advertise or promote any brand or product of any kind, without express, written, prior permission of the trademark or brand owner. The Contest Host may allow the use of their name and or brand as a part of the Contest;
  • not have been published previously, used commercially, submitted to another competition or Contest, or won any other award;
  • be in “good taste” and in keeping with the Contest Host and the SelfiePoll.com brand images and must not be explicit, offensive, obscene, or profane, and must not be derogatory toward any ethnicity, race, gender, sexual orientation, religion, profession, or age group, or promote any activities that may be unsafe or dangerous, as determined by the Contest Host or SelfiePoll.com, in its sole and absolute discretion;
  • not contain any commercial content that promotes any product or service;
  • not defame, misrepresent or contain disparaging remarks about the Contest Host or SelfiePoll.com or their products;
  • not be false, inaccurate or misleading;
  • not violate any law or regulation;
  • not be libelous, threatening or harassing;
  • not instigate others to commit illegal activities or violate human rights; and
  • not contain any viruses, worms, or other interfering computer programming.

4) Entering a Contest:

• You will receive one (1) Entry in the Contest when you Enter your Contest Photo or Contest Video as described in Section 2 and 3, above and in accordance with these Rules.
• LIMIT (1) ENTRY PER PERSON/ACCOUNT DURING THE CONTEST PERIOD For greater certainty and the avoidance of any doubt, you can only use one (1) Account to participate in the Contest.
• If it is discovered that you attempted to enter more than once during the Contest Period, then all your Entries will be void. Use of any automated system to submit Entries is prohibited and will result in disqualification.
• Except where prohibited, participation in the Contest constitutes an entrant’s consent to the SelfiePoll.com and Hosts’s use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
• Contest entrant agrees to release and hold harmless the Contest Parties and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relate in any way to the Contest entry. For greater certainty and the avoidance of any doubt, the Contest Host reserves the right, in its sole and absolute discretion and at any time, to modify, edit or disqualify any Contest entry if a complaint is received with respect to the entry, or for any other reason. If such an action is necessary at any point, then the Contest Host reserves the right, in its sole and absolute discretion, to disqualify the entry and/or the associated entrant. If the Contest Host determines, in its sole and absolute discretion, that any entry does not comply with these Rules for any reason at any time, then the Contest Host or SelfiePoll.com reserves the right, in its sole and absolute discretion, to disqualify the Entry and/or the associated entrant.
• BY SUBMITTING AN ENTRY, YOU ACKNOWLEDGE THAT YOUR ENTRY (INCLUDING YOUR USERNAME AND PROFILE PICTURE) MAY BE POSTED ON SELFIEPOLL, TWITTER, FACEBOOK, INSTAGRAM, SNAPCHAT, TIKTOK, AND/OR CONTEST HOST’S PROPRIETARY WEBSITE, WHERE IT MAY BE VIEWED, SHARED (BY USERS OF VARIOUS OTHER INTERNET-BASED SOCIAL MEDIA SITES) AND COMMENTED ON BY THE CONTEST HOST AND THE GENERAL PUBLIC.

5) Criteria for winning, winner selection and winner responsibilities.

• The criteria for winning is as follows:
  • Each SelfiePoll.com member has one or more votes based upon their membership level. Their vote(s) are cast all for one Contest entry or none for each Contest. Specifically, they can only vote for one Contest entry per Contest.
  • In determining how to vote, SelfiePoll.com members should use the following criteria:
    • 40% the vote consideration is determined by how closely the entry matches with the Contest description from the Contest Host.
    • 30% of the vote consideration is determined by how creative the entry is with regard to the Contest description from the Contest Host.
    • 30% of the vote consideration is based upon how the Contest entry ranks when compared to the other Contest entries.
  • The Contest winner(s) are determined by the total number of votes their entry received from the voting members during the voting period of the Contest. There can be up to five prize values per Contest. The winners will be ranked based upon the total number of votes received from members and the available number of prizes. In the event of a numerical tie, a SelfiePoll.com administrator will cast a deciding vote to break the tie.
• The winning entrants will be contacted via email and notified they are eligible to win.
  • The winning entrants must reply via email within two (2) business days of notification and provide SelfiePoll.com and the Contest Host with a contact phone number. Any additional information needed will be collected after contact.
• The winning entrants submission will be verified, and confirmed prior to award delivery.
• Winning entrants acknowledge that your Contest Photo or Contest Video will appear in Social Media feeds after it is posted and may appear in other electronic and print materials related to the Contest, including promotional materials. By posting a Contest Entry, you irrevocably, perpetually, and without limitation, grant Contest Host and SelfiePoll.com the right to use, publish, adapt, sub-license, edit, dispose of, and/or modify such Contest Photo or Contest Video and the concepts and Third Party Elements embodied therein in any way, in commerce, and in any and all media worldwide in electronic and print materials related to the Contest, and waive all your rights, including moral rights, in the Contest Photo or Contest Video, without notice or compensation, and agree that you may be required to sign a release to that effect.
• Winning entrants must verify they have complied with Contest rules, and must sign liability releases to the Contest Host, SelfiePoll.com and any affiliated companies, agents, advertising and promotion agencies or any other affiliated company organizations.
• If the prize value is over $600, winning entrants must agree to provide IRS information on IRS Form W-9 Request for Taxpayer Identification Number and Certification. A1099-MISC form will be issued to the prize winner in January of the following year for tax filing purposes. Winning entrants are solely responsible for paying any and all local, state, federal, or international taxes associated with their winnings. Neither Contest Host nor SelfiePoll.com will deduct nor report taxes to the IRS. SelfiePoll.com will report total winnings value to the IRS for all winning members who meet or exceed the $600 annual threshold.
• If the prize value is not over $600, but the value of previous winning prizes to the member plus the current prize value is over $600, winning entrants must agree to provide IRS information on IRS Form W-9 Request for Taxpayer Identification Number and Certification. 6) Prize Awards:

• There will be one (1) First Place prize available to be won, and the Contest Host may define up to 4 additional prize levels below the First Place prize (Second Place, Third Place, Fourth Place, Fifth Place).
• Prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at Contest Host’s option. Contest Host reserves the right to substitute a prize or a prize component with one of equal or greater value, including without limitation, but solely in the Contest Host’s discretion, a cash award. Prizes will only be awarded to the person who is the member of the SelfiePoll.com Account entering the Contest.

7) General:

• The Contest is in no way sponsored, endorsed, or administered by, or in association with, Facebook, Instagram, YouTube, Twitter, SnapChat, or TikTok. Any questions or comments regarding the Contest should be directed to the Contest Host or SelfiePoll.com.

• Contest Host and SelfiePoll.com reserves the right to cancel, suspend, withdraw or amend this Contest in any way, without prior notice or obligation, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Contest Host or SelfiePoll.com that interferes with the proper conduct of this Contest as contemplated by these Contest Rules. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Contest Host and SelfiePoll.com reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
• All Entries are subject to verification at any time and for any reason. The Contest Host and SelfiePoll.com reserve the right, in their sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Host and/or SelfiePoll.com – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Contest Host or SelfiePoll.com deems necessary, in their sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the satisfaction of the Contest Host in a timely manner may result in disqualification in the sole and absolute discretion of the Contest Host.
• Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple SelfiePoll.com accounts, shall be deemed as tampering and may disqualify you from entering, participating, winning prizes (defined herein), and could preclude you from participating in future Contests and promotions, at the sole discretion of SelfiePoll.com. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions these rules will be judged void. All Entries become the property of Contest Host and SelfiePoll.com upon receipt and none will be returned. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt.
• Without limitation, the Contest Host and SelfiePoll.com, their advertising and promotion agencies and the Contest voters will not be liable for any failure of the website during the Contest; for an technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any Entry to be received by the Sponsor, its advertising and promotion agencies or the Contest voters for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Contest Host and SelfiePoll.com, their advertising and promotion agencies and the Contest voters will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest.
• In the event of a dispute, Contest Entries will be deemed to have submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the identity of an online entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected Entry.
• The sole determinant of the time for the purposes of a valid online Entry in this Contest will be the SelfiePoll.com Contest server clock.
